Important Information about Personal Information Protection and Privacy
Canadian Kawasaki Motors Inc. ("CKM") is committed to protecting your privacy and maintaining the integrity of any personally identifiable information it collects ("Personal Information"). Due to the sensitive nature of the information CKM collects from its customers ("Customers") and authorized dealers of KAWASAKI-brand motorcycles, all-terrain vehicles, JET SKI personal watercraft and MULE utility vehicles ("Dealers"), which may include a name, address, date of birth, phone numbers, financial information and credit reports, CKM believes it is important to satisfy strict privacy requirements. This Privacy Policy has been prepared to inform you of CKM's policy and practices concerning the collection, use and disclosure of Personal Information provided to CKM. This Privacy Policy also describes the information gathering and dissemination practices for CKM's Internet websites: www.kawasaki.ca, www.teamgreennews.ca, and www.kawasakiracing.ca (the "Sites") and explains how CKM handles Personal Information that it learns about you from your visit to the site.
Changes to Canadian Kawasaki Motors Inc. Practices and this Privacy Policy
This is CKM's current Privacy Policy, in effect as of April 1, 2012. CKM will from time to time review and revise its privacy practices and this Privacy Policy. In the event of any amendment, an appropriate notice will be posted on the Site and communicated to Customers, Dealers, and others in an appropriate manner.
Objective and Scope of this Privacy Policy
This Privacy Policy has been prepared to inform Customers of CKM's policy and practices concerning the collection, use and disclosure of their Personal Information. CKM collects Personal Information that purchasers of KAWASAKI-brand products have provided to Dealers as part of the warranty registration process. CKM also collects information from Customers who apply to obtain information about CKM's products and services. CKM does not sell, trade, rent or otherwise disclose any Personal Information to third parties except as described in this Privacy Policy.
This Privacy Policy governs Personal Information collected from customers for the purposes described herein. It does not govern Personal Information that CKM collects from and about its employees, the protection of which is governed by applicable laws and internal CKM policies. This Privacy Policy also does not cover aggregated data from which the identity of an individual cannot be determined. Using contractual or other arrangements, CKM requests that agents, contractors or third party service providers, who may receive Personal Information in the course of providing services to CKM, protect that Personal Information in a manner consistent with the principles articulated in this Privacy Policy.

Why does CKM collect your Personal Information?
CKM collects Personal Information about you and uses it for the following reasons: (a) to identify you; (b) to comply with legal requirements; (c) to administer product warranties; (d) to provide you with recall notices and other safety and maintenance information; (e) to protect CKM and you against fraud; (f) to administer contests, surveys and promotions; (g) to co-operate with law enforcement and to protect against violations of criminal or civil laws; (h) for marketing purposes to provide you with information regarding products and services that you have requested or that you may be interested in and to send you promotional offers; and (i) to better understand your interests.
What type of Personal Information does CKM collect?
CKM collects various types of Personal Information. Some examples of Personal Information collected may include your name, address, telephone number, e-mail address, motor vehicle registration number, insurance information and motor vehicle licence number.
Where does CKM collect Personal Information from?
CKM collects Personal Information from waiver forms filled out at events and test rides, from contest ballots, from online contest forms, online surveys, The Kawasaki Member's Area (Lounge) and information request forms filled out online or at a dealership or at an event.
How Does Canadian Kawasaki Motors Inc. Collect Personal Information?
CKM may obtain and collect your Personal Information through the following means:
Manual and Electronic Forms. During your visit to a Dealer, you may be asked to complete and/or provide information in order that the Dealer can complete various forms for releasing various types of Personal Information. Forms you may be asked to complete fall in the following categories:
Financial Services and Credit Applications: In order to extend any financing, CKM and/or third parties will first have to obtain information about you and verify your financial history. You may be required to provide CKM and/or a third party with your name, address, banking information, credit history and social insurance number.
Warranty Registration: CKM has established a warranty registration program. CKM and its Dealers use your Personal Information in order to register you and your KAWASAKI-brand product for the warranty program and to administer the warranty. In addition, this information is used to communicate with you in the event of a product recall or for other safety and maintenance communications.
CKM's use of Personal Information is limited to these purposes. Unless permitted by law, no Personal Information about a Customer is collected without first obtaining the consent of the individual to the collection, use and disclosure of that information.
The Disclosure of Personal Information
CKM does not sell Personal Information it collects to third parties. CKM may share your Personal Information with its Dealers and provincial and federal governments and agencies, insurance companies and law enforcement for security, health and safety and for legal, taxation or regulatory compliance reasons. CKM may also share your personal information with its affiliates, who will also be bound to respect this privacy policy.
Where obliged or permitted to disclose information without consent, CKM will not disclose more information than is required.
Accuracy, Retention and Security
CKM endeavours to ensure that any Personal Information provided by Customers and in its possession is accurate, current and complete as necessary for the purposes for which CKM uses that information.
CKM maintains reasonable physical, electronic and procedural safeguards to protect your Personal Information from unauthorized access, disclosure, misuse, alteration or destruction. CKM's networking systems include an industry standard firewall and systems that are both physically and logically protected (via secured locations and passwords). Customer information will be regularly backed-up and stored in a secure location. Other data will be kept on an industry standard computer database fully protected behind a firewall.
Subject to any applicable legal requirements, CKM retains Personal Information about customers as long as CKM believes it is necessary to fulfill the purposes for which it was collected. Personal Information about Customers that is maintained on CKM's systems is protected using industry standard security measures. However, CKM cannot guarantee that the information submitted to CKM using the Site will be completely secure as transmission of information over the Internet is susceptible to possible loss, misrouting, interception and misuse.

Verifying and Amending your Personal Information
You can access and review Personal Information held by CKM and make corrections to it. Please call CKM's Privacy Officer at (416) 445-7775 for assistance. You may be required to put your request in writing. If there will be any charge for your request, CKM will advise you in advance. In some cases CKM will be required to keep information confidential, if any requests for access to Personal Information are denied, we will provide you with an explanation. To protect your privacy and security, CKM will require sufficient information to allow it to confirm the identity of the person making the request before granting access or making corrections.

The Company reserves the right to terminate your use of the Site and the Material at any time, for any reason, with or without cause, if the Company believes that you are violating these Terms and Conditions in any way. Sections 1, 2, 3, 4, 5, 6, 8, 9 and 11 will survive any termination of these Terms and Conditions for any reason.

The Company makes no claims that the Material (including Software) is appropriate or it may be downloaded outside of Canada. These Terms and Conditions and any action thereto or related to the Site, the Material and the Software are governed by laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without giving effect to conflict of laws principles. The United Nations Convention on the International Sale of Goods is explicitly excluded from this agreement. You agree that any action at law or in equity arising out of or relating to these Terms and Conditions or your use of the Site, the Material and the Software will be filed only in a court located in Toronto, Ontario, Canada, and you irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts for the purpose of any such action. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of these Terms and Conditions, which will remain in full force and effect. No waiver of any term within these Terms and Conditions will be deemed a further or continuing waiver of such term or any other term.
